We may tell the Referrer whether their referral link has been used and whether an eligible reward has been earned. We will not disclose the Referred Friend’s order contents, delivery address, payment details or other unnecessary information.

Participation in the Refer a Friend Programme does not automatically subscribe either person to marketing communications.

Where our referral platform allows a Referrer to enter another person’s contact details, the Referrer must have that person’s permission to provide those details and to send the referral invitation.

8. Cookies and similar technologies

Cookies are small data files stored on your browser or device. We and our service providers may use cookies, pixels, tags, software development kits and similar technologies.

These may include:

Strictly necessary technologies

These are required for functions such as:

  • Shopping-cart operation
  • Checkout
  • Payment processing
  • Account login
  • Website security
  • Fraud prevention
  • Remembering privacy choices

These technologies cannot always be disabled without affecting the operation of the website.

Functional technologies

These help provide enhanced functions, such as:

  • Remembering preferences

Analytics technologies

These help us understand:

  • How visitors use the website
  • Which pages and products are viewed

Advertising technologies

These may help us:

  • Measure advertising performance
  • Understand whether an advertisement resulted in a website visit or purchase
  • Build advertising audiences
  • Display more relevant advertising
  • Limit repeated advertising

Where required, non-essential technologies will only operate after you have provided consent.

Managing cookie preferences

You may manage available cookie choices through the cookie banner or privacy-preferences tool on our website.

You can also control cookies through your browser settings. Blocking some cookies may affect website functionality, account features or the shopping experience.

Your preferences may apply only to the browser and device on which they were selected. You may need to update them again if you clear cookies, change browsers or use another device.

9. Marketing and advertising choices

You may unsubscribe from promotional emails at any time by:

  • Selecting the unsubscribe link in a marketing email
  • Updating available account preferences
  • Contacting hello@crescentnest.com

Unsubscribing from marketing will not prevent us from sending essential service communications relating to an order, account, subscription, referral, warranty or customer-service enquiry.

We may provide limited information—such as cookie identifiers, hashed contact details or website activity—to analytics and advertising providers to measure campaigns, create audiences or deliver relevant advertising where permitted.

We do not sell personal information for money or rent customer lists to third parties.

Where a data-sharing opt-out option is available on our website, you may use it to request that eligible information not be used or disclosed for targeted-advertising purposes.

10. Who we share personal information with

11. Overseas processing and disclosure

Crescent Nest is based in New Zealand, but some of our service providers operate or store information in other countries.

As a result, personal information may be processed or stored outside New Zealand, including in countries where our ecommerce, payment, fulfilment, email, analytics, advertising, referral, review and technology providers operate.

Privacy laws in those countries may differ from New Zealand law.

Where personal information is disclosed to an overseas organisation, we take reasonable steps to ensure that:

  • The recipient is subject to appropriate privacy obligations
  • Contractual or other safeguards are in place
  • The disclosure is otherwise permitted by law
  • You have been appropriately informed where express authorisation is required

Some overseas providers may process information on our behalf rather than receiving it for their own independent purposes.

12. Public reviews and content

When you submit a product review, social-media comment, testimonial, photograph, video or other public-facing content, information you choose to include may be visible to other people.

This may include:

  • Your display name
  • Review or testimonial
  • Rating
  • Photograph or video
  • Social-media username
  • Other information you choose to make public

Please do not include private or sensitive information in public reviews or comments.

We may moderate, decline or remove content that is unlawful, misleading, abusive, discriminatory, unrelated to the product or inconsistent with our content guidelines.

13. Aggregated and de-identified information

We may combine or de-identify information so that it no longer reasonably identifies an individual.

We may use aggregated or de-identified information for:

  • Business analysis
  • Product development
  • Website improvement
  • Sustainability and impact reporting
  • Customer research
  • Marketing measurement
  • Statistical reporting

Where information has been properly de-identified, it is not treated as personal information under this policy unless required by applicable law.

14. How long we retain information

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention periods depend on:

  • Whether an account or subscription remains active
  • The length of a customer or business relationship
  • Warranty, return and dispute periods
  • Fraud-prevention and security needs
  • Tax, accounting and legal requirements

For example:

  • Order, payment and tax records are generally retained for at least seven tax years.
  • Customer-account information may be retained while the account remains active and for a reasonable period afterwards.
  • Warranty, return and Circular Care records may be retained for the relevant product, claim and dispute period.
  • Marketing information may be retained until you unsubscribe or it is no longer required.
  • We may retain limited suppression information to ensure we continue to respect an unsubscribe request.
  • Referral and promotion information may be retained for the period needed to administer the programme, prevent fraud and resolve disputes.
  • Customer-service records may be retained for quality, training, complaint and legal purposes.

When information is no longer required, we will take reasonable steps to delete, destroy or de-identify it.

15. Security

We use reasonable administrative, organisational and technical safeguards appropriate to the nature of the information we hold.

These may include:

  • Access controls
  • Secure passwords and account controls
  • Encryption of information in transit

  • Restricted staff access
  • Security monitoring
  • Fraud-prevention processes
  • Staff procedures for handling personal information
  • Backup and incident-response processes

No website, transmission or storage system can be guaranteed to be completely secure.

You are responsible for keeping your account password and login information confidential. Please contact us promptly if you believe your account or personal information has been compromised.

16. Privacy breaches

If we become aware of a suspected privacy or security incident, we will take reasonable steps to:

  • Investigate the incident
  • Contain it
  • Protect affected information
  • Reduce the risk of harm
  • Prevent a similar incident from happening again

Where a privacy breach has caused or is likely to cause serious harm, we will notify affected individuals and the New Zealand Office of the Privacy Commissioner as required by law, unless a lawful exception applies.

We do not knowingly collect personal information directly from children under 16 without the involvement or permission of a parent or guardian.

If you believe a child has provided personal information to us without appropriate permission, please contact our Privacy Officer. We will review the circumstances and take appropriate action, which may include deleting the information.

20. Third-party websites and services

Our website may contain links to independent websites, social-media platforms, payment services or other third-party services.

Those organisations have their own privacy policies and practices. Crescent Nest is not responsible for how an independent third party collects, uses or protects personal information.

We encourage you to review the relevant privacy policy before providing information to an external service.
