Welcome to Crescent Nest.
These Terms of Service explain the conditions that apply when you visit our website, create an account, purchase our products or use our services and programmes.
Please read them carefully. By using the Crescent Nest website or placing an order, you agree to these Terms of Service, together with any policies or additional terms referred to below.
1. About Crescent Nest
Crescent Nest is operated by Crescent International Limited, NZBN 9429052451805, trading as Crescent Nest.
In these Terms, “Crescent Nest”, “we”, “us” and “our” refer to Crescent International Limited.
Crescent Nest is a New Zealand business selling goods in trade.

3. Acceptance of these Terms
By accessing our website, creating an account or placing an order, you confirm that:

- You have the legal authority to enter into the transaction
- You will use the website and products lawfully
You must not use the website or place an order if you do not accept these Terms.
4. Age and authority to purchase
You must be at least 18 years old to place an order, or place the order with the involvement and permission of a parent or legal guardian.
By placing an order on behalf of another person or organisation, you confirm that you have authority to do so.
Product age recommendations are separate from the legal authority required to place an order. Please follow the age and safety guidance shown on the relevant product page and product instructions.
5. Customer accounts
You may be able to create a Crescent Nest customer account.
You agree to:
- Provide accurate and current information
- Keep your login details confidential
- Not create an account using another person’s identity
- Notify us promptly if you suspect unauthorised use
- Update information that changes
You are responsible for activity carried out through your account where that activity results from your failure to keep your login information secure.
We may suspend or restrict an account where reasonably necessary to address:
- Suspected fraud
- Unauthorised access
- Security risks
- Material breaches of these Terms
- Unlawful activity
- Misuse of promotions, referral codes or subscriptions
We will act reasonably and, where appropriate, give you an opportunity to contact us about the restriction.
6. Product information
We take reasonable care to ensure that product descriptions, images, prices, specifications and availability are accurate.
However:
- Colours and appearances may vary slightly between screens
- Natural materials such as bamboo may vary in tone, grain and texture
- Packaging may change from time to time
- Product measurements may be approximate
- Product improvements may result in minor specification changes
- Images may include props or accessories that are not included unless expressly stated
Natural variations that do not affect the product’s use, quality or performance are not normally considered defects.
The contents of each purchase are those listed in the relevant product description at the time the order is placed.
We will not materially substitute a product or component without your agreement.
7. Product suitability and oral-health information
Product descriptions, articles, guides and educational material provided by Crescent Nest are for general information only.
They are not a substitute for personalised advice from a dentist, doctor or other qualified health professional.
You should seek appropriate professional advice where you have concerns relating to:
- An oral-health condition
- Gum sensitivity or bleeding
- Dental surgery or treatment
- Braces, implants, crowns or other dental work
- Allergies or material sensitivity
- Whether a product is appropriate for a child
- Persistent pain or discomfort
Stop using a product and seek appropriate advice if it causes unexpected pain, irritation, swelling or another concerning reaction.
Nothing in this section limits our responsibility for the safety or quality of our products or your rights under applicable consumer law.
8. Product use and compatibility
Products should be used, charged, cleaned, stored and disposed of in accordance with:
- The product instructions
- The relevant product page
- Our care and disposal guidance
- Reasonable safety precautions
Crescent Nest replacement brush heads, charging bases, handles and accessories are designed for use with the compatible Crescent Nest products identified on the relevant product page.
Unless expressly stated otherwise:
- Crescent Nest brush heads are not compatible with other toothbrush brands
- Third-party brush heads may not fit Crescent Nest handles
- Unauthorised chargers or electrical components should not be used
- Products should not be modified, dismantled or repaired by an unauthorised party
Damage caused solely by misuse, incompatible components, unauthorised modification or failure to follow product instructions may fall outside our manufacturer warranty, subject always to applicable consumer law.
9. Placing an order
When you place an order, you are offering to purchase the selected products under these Terms.
After you submit the order, you will normally receive an automated confirmation email. This confirms that we have received your order, but does not necessarily mean that the order has been accepted.
Unless we expressly confirm acceptance earlier, an order is accepted when we confirm that it has been dispatched.
We may contact you before accepting an order where we need to:
- Verify information
- Confirm availability
- Correct an obvious error
- Review suspected fraud
- Confirm a delivery destination
- Resolve a payment issue
You should check your order confirmation and contact us promptly if any details are incorrect.
10. Order limits and personal use
Website orders are intended primarily for personal and household use.
We may reasonably limit or decline quantities where we believe an order:
- Is intended for unauthorised resale
- Exceeds normal household requirements
- Is connected to fraud or promotion misuse
- Was placed using automated purchasing methods
- May breach a distribution, export or legal restriction
Customers wishing to purchase for resale or business use should contact us about an appropriate wholesale or commercial arrangement.
11. Product availability
All products are subject to availability.
Placing an item in your cart does not reserve it.
If a product becomes unavailable after you place an order, we may:
- Contact you with an expected availability date
- Offer an alternative with your agreement
- Remove the unavailable item and refund it
- Cancel and refund the affected order
We will not charge you for a product we cannot supply.
Pre-order or back-order products, where offered, will be subject to the estimated timing shown on the relevant page. Estimated dates may change, and we will provide reasonable updates where there is a material delay.
12. Prices and currencies
Prices are displayed in the currency selected on the website or shown at checkout.
The currency and final amount displayed at checkout will apply to your order.
Depending on the selected destination, prices may be shown in:
- New Zealand dollars
- Australian dollars
- United States dollars
- Another currency expressly displayed at checkout
Prices include GST or other sales tax where the website states that tax is included.
Shipping, import duties, taxes and other charges that are not included in the product price will be shown at checkout where reasonably possible or addressed in our Shipping Policy.
Where your bank, card provider or payment service converts the transaction into another currency, it may apply its own exchange rate or fee. Crescent Nest does not control those charges.
13. Pricing and display errors
We take reasonable care to keep prices and product information accurate.
If a product is listed at an obviously incorrect price or with a material description error, we may contact you before accepting the order and offer you the choice to:
- Proceed with the corrected information
- Select another product
- Cancel the affected item or order for a full refund
We will not change the price of an accepted order unless:
- The change is required by law
- You agree to the change
- The displayed error was so obvious that a reasonable customer would have recognised it as an error
Promotional pricing applies only during the stated promotional period and while applicable stock is available.
14. Payment
Payment must be made using one of the payment methods displayed at checkout.
Depending on the market and device, these may include:
- Credit or debit card
- PayPal
- Shop Pay
- Apple Pay
- Google Pay
- Afterpay
- Other payment providers displayed at checkout
Payment services may be subject to the provider’s own terms and privacy policy.
You confirm that:
- You are authorised to use the selected payment method
- The payment and billing information is accurate
- Sufficient funds or credit are available
- The transaction is not fraudulent or unlawful
We may delay dispatch while payment is being authorised or reviewed.
If payment is declined, reversed or charged back, we may suspend fulfilment or cancel the affected order.
15. Order cancellation by Crescent Nest
Before an order is accepted, we may decline or cancel it for a reasonable reason, including:
- The product is unavailable
- Payment is not authorised
- An obvious pricing or description error has occurred
- We reasonably suspect fraud
- The order appears to be for unauthorised resale
- We cannot deliver to the nominated destination
- The order would breach applicable law
- The customer has materially breached these Terms
If payment has already been collected, we will refund the relevant amount to the original payment method.
We will not cancel an accepted order arbitrarily.
16. Customer order cancellation
Contact us as soon as possible if you need to cancel or change an order.
We will try to assist, but an order cannot always be changed once it has been processed or dispatched.
If an order has already been dispatched:
- You may need to follow the returns process
- Change-of-mind return conditions may apply
- Shipping costs may not be refundable
- You may be responsible for return delivery costs
Your statutory cancellation, rejection and refund rights are not limited by this section.
17. Shipping and delivery
Shipping destinations, charges and estimated delivery timeframes are set out in our Shipping Policy and at checkout.
Delivery estimates begin after dispatch unless otherwise stated.
Delivery timeframes are estimates rather than guaranteed dates, except where we have expressly agreed to deliver by a specific date.
We will take reasonable steps to:
- Dispatch orders promptly
- Provide tracking where available
- Investigate material delivery delays
- Assist with lost or damaged parcels
Events outside our reasonable control, such as courier disruption, severe weather, customs processing, border closures or transport interruption, may cause delays.
We will not be responsible for delay caused solely by such events where we have taken reasonable steps to minimise the effect and assist the customer. This does not limit any mandatory right relating to delivery, cancellation or refund.
18. Delivery information and authority to leave
You are responsible for providing a complete and accurate delivery address.
Please contact us promptly if you notice an error. We cannot guarantee that an address can be changed after an order has been processed.
Where a parcel is returned because:
- The address provided was incorrect or incomplete
- The customer did not collect the parcel
- The recipient refused delivery without a valid legal reason
we may ask the customer to pay reasonable re-delivery costs.
Where you authorise a courier to leave a parcel unattended, delivery may be treated as completed when it is left in accordance with that authority. This does not apply where the courier fails to follow the delivery authority or acts negligently.
19. Risk and lost parcels
For consumer orders, responsibility for the goods remains with Crescent Nest until the goods are delivered to you or to a person or location authorised by you.
If tracking shows a parcel as delivered but you cannot locate it, contact us promptly so we can investigate with the delivery provider.
If a parcel is lost before delivery, we will assess the circumstances and provide an appropriate remedy, which may include replacement or refund.
This does not apply where the loss results solely from:
- An incorrect address supplied by the customer
- An unauthorised redirection requested by the customer
- A failure to collect the parcel after reasonable notice
- Delivery to a location expressly authorised by the customer
Any such situation will be considered reasonably and in accordance with applicable consumer law.
20. International orders, customs and import charges
International orders may be subject to:
- Import duties
- Customs fees
- Sales or consumption taxes
- Border-processing charges
- Local import requirements
Unless checkout expressly states that these charges are included, they are the responsibility of the purchaser or recipient.
Crescent Nest cannot predict whether a destination authority will impose a charge.
Customers are responsible for checking whether a product may legally be imported into the destination country.
We will not alter order values or documents to avoid lawful customs charges.
Where an order is delayed, refused or seized because the recipient has not complied with destination-country requirements, Crescent Nest will assess any refund request reasonably. We may deduct reasonable, unrecoverable shipping, return, customs or handling costs where legally permitted.
Nothing in this section excludes any mandatory rights available under the laws applying to the transaction.
21. Returns and change of mind
Our Refund Policy explains how to request a return.
Unless a separate guarantee applies, change-of-mind returns generally require the product to be:
- Returned within the stated return period
- Unused and undamaged
- In its original packaging
- Complete with all included components
- Accompanied by proof of purchase
For hygiene reasons, opened or used consumable and personal-care items may not be eligible for change-of-mind return. These may include:
- Toothbrush heads
- Dental floss
- Tongue scrapers
- Other products identified as hygiene-sensitive
This hygiene exclusion does not apply where an item is faulty, unsafe, incorrectly supplied or otherwise subject to a remedy under consumer law.
Clearance and promotional products may be excluded from change-of-mind returns where that exclusion is clearly disclosed before purchase. Statutory rights relating to faulty or misdescribed goods remain unaffected.
22. Thirty-Day Money-Back Guarantee
Eligible Crescent Nest toothbrush purchases may be covered by our 30-Day Money-Back Guarantee.
The guarantee allows an eligible customer to try the toothbrush and request a refund within 30 days after delivery, subject to the conditions displayed on the Money-Back Guarantee page.
The toothbrush must generally be returned with:
- Its original packaging
- The charger
- The cable
- The user guide
- Other reusable components included with the purchase
- Proof of purchase
For hygiene reasons, used brush heads, dental floss and tongue scrapers are excluded from the refundable value unless they are faulty or a remedy is required by law.
Return shipping and original shipping charges are handled in accordance with the Money-Back Guarantee and Refund Policy.
The 30-Day Money-Back Guarantee is a voluntary benefit provided in addition to statutory consumer rights.
23. Faulty, damaged or incorrect products
Please contact us as soon as reasonably possible if a product:
- Arrives damaged
- Is faulty
- Is unsafe
- Is materially different from its description
- Is missing an included component
- Is not the product ordered
We may request reasonable information to assess the issue, such as:
- Order number
- Description of the problem
- Photographs or video
- Product serial or batch information
- Basic troubleshooting steps
Where a product does not meet an applicable consumer guarantee, the available remedy will depend on the circumstances and applicable law.
A request to notify us promptly helps us investigate transit damage and delivery issues. Failure to notify us within an informal requested timeframe does not remove any statutory right.
24. Manufacturer warranties
New toothbrushes
A new Crescent Nest Sustainable Sonic Toothbrush is covered by a two-year manufacturer warranty against manufacturing defects, beginning on the delivery date.
Refurbished toothbrushes
A Crescent Nest Refurbished Sonic Toothbrush is covered by the warranty period stated on its product page when purchased. The current refurbished toothbrush warranty is one year from delivery.
Other electrical products and replacement components
Replacement handles and other electrical components are covered by the warranty period displayed on the relevant product page or order confirmation at the time of purchase.
What the manufacturer warranty may cover
Subject to assessment, the warranty may cover manufacturing or performance faults affecting normal use.
Where a valid claim is accepted, Crescent Nest may provide an appropriate repair, replacement or other remedy.
What the manufacturer warranty does not ordinarily cover
The warranty does not ordinarily cover damage caused solely by:
- Normal cosmetic wear
- Accidental dropping or impact
- Misuse or neglect
- Prolonged improper storage
- Use contrary to product instructions
- Unauthorised repair or modification
- Use with incompatible components
- Loss or theft
- Consumable brush-head wear
- Damage arising after the product has been disposed of or materially altered
Any exclusion will be applied reasonably and does not limit rights that cannot legally be excluded.
Our manufacturer warranties provide benefits in addition to statutory consumer rights.
25. Warranty claims
To make a warranty claim, contact Crescent Nest with:
- Proof of purchase
- Order details
- A description of the issue
- Photographs or video where reasonably helpful
- Product serial information where available
We may ask you to carry out reasonable troubleshooting before returning the product.
Do not send a product to us before receiving return instructions.
Where the claim is valid, Crescent Nest will cover reasonable return or replacement shipping costs.
Where inspection shows that the product is not faulty and the issue falls outside the warranty, we will contact you before charging any return, repair or replacement cost.
26. Consumer rights
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded.
For New Zealand consumers, this includes rights under the:
- Consumer Guarantees Act 1993
- Fair Trading Act 1986
- Contract and Commercial Law Act 2017
- Other applicable consumer legislation
Depending on the circumstances, consumer guarantees may include that goods:
- Are of acceptable quality
- Are reasonably fit for their intended purpose
- Match their description
- Are delivered within the agreed or a reasonable time
The 30-Day Money-Back Guarantee and manufacturer warranties are additional benefits. They do not replace or restrict statutory rights.
International customers may also have mandatory rights under the laws applying in their country of residence.
27. Refill subscriptions
Where Crescent Nest offers a product subscription, the product, price and delivery frequency will be shown before you subscribe.
By starting a subscription, you authorise Crescent Nest and its payment provider to charge the selected payment method automatically at the displayed interval until the subscription is cancelled.
Subscription orders
Each recurring subscription order is subject to:
- Product availability
- The price applying to the subscription
- Successful payment
- The delivery address and frequency saved to the subscription
- These Terms and any additional subscription terms
Managing a subscription
Available subscription controls may include:
- Changing the delivery date
- Changing the frequency
- Skipping an order
- Pausing the subscription
- Updating payment details
- Updating the delivery address
- Cancelling the subscription
Changes must be completed before the next order is processed.
Once a subscription order has been processed or dispatched, we may not be able to cancel it for change-of-mind reasons. Applicable return and consumer rights will still apply.
Subscription price changes
We may change a subscription price where reasonably necessary.
Where the change is material, we will provide reasonable advance notice before it applies to a future renewal. You may cancel the subscription before the new price takes effect.
Failed payments
If a recurring payment fails, we may:
- Retry the payment
- Ask you to update the payment method
- Delay the shipment
- Pause or cancel the subscription after reasonable attempts to contact you
Unavailable subscription products
If a subscribed product becomes unavailable, we may pause the affected order, contact you or provide a refund.
We will not substitute a materially different product without your agreement.
28. Circular Care System
Crescent Nest’s Circular Care System may include:
- Replacement handles
- Product returns
- Repair assessment
- Refurbishment
- Reuse of serviceable products or components
- Responsible recycling of components that cannot be reused
The specific conditions and inclusions will be shown on the relevant Circular Care or product page.
Where a Circular Care purchase requires an old handle to be returned:
- The return must follow the provided instructions
- The prepaid return label must be used as directed
- The returned product should be the eligible Crescent Nest product being replaced
- The replacement may not be dispatched until the return is received, where stated
A prepaid label has no cash value and must not be used for another item.
Participation in Circular Care does not guarantee that every returned product can be repaired or refurbished. Crescent Nest may use recoverable components and responsibly recycle the remainder.
29. Refurbished products
Refurbished products are pre-owned or returned products that have been inspected, cleaned, sanitised, repaired where needed and performance-tested before resale.
A refurbished product may show minor cosmetic marks, including:
- Small scratches
- Light scuffs
- Minor surface variation
These marks will not ordinarily affect performance or safety.
Any material condition difference will be disclosed on the product page.
For hygiene reasons, refurbished toothbrush sets include new, unused brush heads where the product description says they are included.
Refurbished products are covered by the warranty period shown at the time of purchase and by applicable consumer law.
30. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions, including:
- Start and end dates
- Minimum spend
- Product exclusions
- Customer eligibility
- Usage limits
- Country or currency restrictions
- Stock availability
Unless expressly stated otherwise:
- Only one discount code may be used per order
- A code cannot be exchanged for cash
- A code cannot be applied retrospectively
- A code cannot be sold or reproduced commercially
- Shipping does not count towards a minimum product spend
- Discounts cannot reduce an order below zero
- Any unused value is forfeited
We may cancel a discount or order connected to fraud, technical misuse or a material breach of the promotion conditions.
31. Referral Programme
The Crescent Nest Refer a Friend Programme is governed by the separate Referral Programme Terms and Conditions.
Participating in the referral programme does not automatically subscribe a participant to marketing communications.
Referral codes must not be used for:
- Self-referrals
- Bulk or unsolicited messaging
- Paid advertising
- Coupon-code websites
- False accounts
- Misleading promotion
- Unauthorised commercial activity
Where the Referral Programme Terms conflict with this section, the Referral Programme Terms will apply.
32. Gift cards and store credit
Where Crescent Nest offers gift cards or store credit, additional terms may be displayed at purchase or issue.
Unless otherwise stated:
- Gift cards and store credits have no cash value
- They cannot be used to purchase another gift card
- They cannot be replaced where lost or used without authorisation, unless required by law
- The holder is responsible for protecting the code
- Any expiry period will comply with applicable law
Statutory refunds will not be provided solely as store credit where the customer is legally entitled to a monetary refund.
33. Reviews, testimonials and submitted content
You may be able to submit:
- Product reviews
- Ratings
- Comments
- Photographs
- Videos
- Testimonials
- Survey responses
- Social-media content
- Other material
You retain ownership of your original content.
By submitting content through a Crescent Nest review, form or community feature, you give Crescent Nest a non-exclusive, worldwide, royalty-free licence to host, reproduce and display the content for the purpose for which it was submitted, including on our website and organic brand channels.
We will seek additional permission where reasonably appropriate before using identifiable customer content materially outside its original context, particularly in paid advertising.
You confirm that:
- You have the right to submit the content
- The content is genuine and not misleading
- It does not infringe another person’s rights
- It does not contain unlawful, abusive or discriminatory material
- It does not contain another person’s private information without permission
We may moderate or remove content that is unlawful, misleading, offensive, irrelevant, fraudulent or inconsistent with our published guidelines.
We are not required to remove a genuine negative review solely because it is critical of Crescent Nest.
34. Intellectual property
The Crescent Nest website and its contents may include:
- Trade marks
- Logos
- Product names
- Product designs
- Text
- Images
- Videos
- Graphics
- Illustrations
- Icons
- Website code
- Educational material
- Packaging designs
These materials are owned by Crescent Nest or used with permission and are protected by applicable intellectual-property laws.
You may view and use the website for personal, non-commercial purposes.
Without prior written permission, you must not:
- Reproduce substantial website content
- Modify or distribute our materials
- Use Crescent Nest branding commercially
- Use our content in paid advertising
- Create misleading copies of our website or products
- Remove ownership or trade-mark notices
- Suggest that Crescent Nest endorses an unauthorised product or service
Retailers, affiliates and partners may use approved brand materials only in accordance with their agreement and our brand guidelines.
35. Prohibited website use
You must not use the website to:
- Break any applicable law
- Commit or facilitate fraud
- Interfere with website security
- Introduce malware or harmful code
- Access accounts or systems without authorisation
- Scrape the website through unreasonable automated methods
- Impersonate another person
- Submit false order or payment information

- Infringe intellectual-property or privacy rights
- Harass, threaten or abuse another person
- Distribute spam
- Carry out unauthorised resale or commercial activity
We may take reasonable steps to prevent or investigate prohibited conduct.

Independent third parties may have their own terms and privacy policies.
Crescent Nest does not control independent third-party websites and is not responsible for their unrelated content, availability or practices.
This section does not remove Crescent Nest’s responsibility for service providers we appoint to perform our own obligations to you.
37. Privacy
We collect and handle personal information in accordance with our Privacy Policy.
Where consent is required for a particular activity, such as certain marketing communications or non-essential cookies, we will request it separately.
Acceptance of these Terms does not, by itself, constitute consent to all marketing or advertising tracking.
38. Website availability
We aim to keep the website available, secure and accurate, but cannot guarantee that it will always operate without interruption.
We may temporarily suspend or restrict parts of the website for:
- Maintenance
- Upgrades
- Security
- Technical problems
- Legal compliance
- Operational changes
We will take reasonable steps to minimise material disruption.
We may correct typographical, technical or display errors. Correcting an error will not remove rights relating to an order already accepted.
39. Events beyond reasonable control
Neither party will be responsible for delay or failure caused by an event beyond its reasonable control where reasonable steps have been taken to reduce the impact.
Such events may include:
- Natural disasters
- Severe weather
- Fire or flood
- Transport disruption
- Customs or border delays
- Government restrictions
- Widespread network or system outages
- Industrial action
- Epidemics or public-health emergencies
Where such an event materially delays an order, we will provide reasonable updates and work with the customer on an appropriate solution.
This section does not limit mandatory rights relating to non-delivery, cancellation or refunds.
40. Limitation of liability
Nothing in these Terms excludes or limits Crescent Nest’s liability where doing so would be unlawful.
This includes liability arising under applicable consumer-protection legislation.
To the maximum extent permitted by law, Crescent Nest will not be responsible for loss caused solely by:
- Customer misuse
- Failure to follow product instructions
- Unauthorised product modification
- Use of incompatible components
- Inaccurate information provided by the customer
- Unlawful use of the website or products
- An event beyond our reasonable control that we could not reasonably prevent
We are not responsible for indirect commercial loss arising from products purchased for personal use, including lost business revenue, profit or opportunity, except where liability cannot lawfully be excluded.
Where liability may legally be limited, it will be limited to the remedies reasonably available in the circumstances.
This section must be read together with the consumer-rights section and must not be interpreted as limiting a mandatory right or reasonably foreseeable remedy available under law.
41. Suspension and termination
We may suspend or terminate access to an account or website feature where reasonably necessary because of:
- Material breach of these Terms
- Fraud or attempted fraud
- Unlawful conduct
- Serious security risk
- Repeated promotion or referral abuse

- A legal or regulatory requirement
Where appropriate, we will explain the reason and give the customer an opportunity to contact us.
Termination does not affect:
- An accepted order
- An accrued payment obligation
- An existing consumer right
- Provisions intended to continue after termination
42. Changes to these Terms
We may update these Terms to reflect changes in:
- Our products and services
- Our website
- Our programmes
- Our business operations
- Applicable law
- Technology or security requirements
The “Last updated” date will show when the Terms were most recently revised.
Changes will apply to website use and orders placed after the revised Terms take effect.
They will not retrospectively change an order already accepted unless:
- The change is required by law
- You agree to it
- The change does not disadvantage you
Where a change materially affects an ongoing subscription or programme, we will provide reasonable advance notice where practicable.
43. Governing law and disputes
These Terms are governed by the laws of New Zealand.
The parties submit to the non-exclusive jurisdiction of the New Zealand courts and tribunals.
Nothing in this section prevents an international consumer from relying on mandatory consumer protections or dispute-resolution options available under the laws applying in their country of residence.
If a concern arises, please contact us first so we have an opportunity to resolve it fairly.
New Zealand customers may also be able to bring an eligible claim through the Disputes Tribunal or contact an appropriate consumer or regulatory authority.
44. General provisions
Entire agreement
These Terms, together with the relevant order details, product information and incorporated policies, form the agreement relating to your retail purchase or website use.
Severability
If part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
No waiver
If Crescent Nest does not immediately enforce a right under these Terms, that does not mean the right has been waived.
Assignment
You may not transfer your rights or obligations under an order without our agreement.
Crescent Nest may transfer its rights and obligations as part of a genuine business sale, restructure or transfer, provided this does not reduce your existing consumer rights.
Headings
Headings are included for readability and do not change the meaning of these Terms.
Electronic communications
You agree that order confirmations, notices and other transaction-related communications may be provided electronically using the contact details supplied by you.
